161 municipalities are affected by this law in the territory of the greater region currently. **Definition ** * SRU: Urban Solidarity and Renewal * DALO: Right to Housing Opposable **** **Who is concerned?** The provisions of Article L302-5 of the CCH shall apply to municipalities with a population of at least 3500 inhabitants (1,500 inhabitants in Île-de-France) which are included, within the meaning of the population census, in an agglomeration or EPCI of more than 50000 inhabitants comprising at least one municipality of more than 15000 inhabitants. By Decree No 2013-671 of 24 July 2013, all the agglomerations and EPCI Bretons are in the list of territories which do not justify an additional production effort to meet the demand and capacity to accommodate people with low incomes and disadvantaged people. The rate of 20 % of social rental housing to be reached within the main residences is therefore maintained. This decree also establishes the list of municipalities in population growth justifying an effort to produce social rental housing. Brittany is not covered by this list. **Annual inventory and sampling** Municipalities with less than 20 % of social rental housing are subject to a levy on their tax resources to support the land and real estate acquisitions necessary for the production of these dwellings. A contradictory inventory is carried out every year between the State and each municipality concerned to determine the number of social rental units existing on 1 January of the year preceding the levy. The levy corresponds to 20 % of the tax potential per capita, per missing dwelling. The beneficiaries of the levy shall be in order of priority: EPCI having the delegation of aid to the stone to which the collected municipality belongs, the local land establishment, the regional urban planning fund (FAU). **A three-year commitment** Objectives for the realisation of the social rental housing to be achieved in the territory of each municipality are set through the Habitat Local Programmes. An evaluation of this scheme is planned at the end of the three-year period. The law provides for three-year targets based on the number of missing housing units, and gradually increasing in order to reach the required rate of 20 % of social rental housing by 2025.
